THEREFORE YOU MUST PRIOR TO RECEIVING RESTRUCTURING SECURITIES (I) DESIGNATE A HOLDER AFFILIATE FOR PURPOSES OF RECEIVING THE MCBS, LENDERS BACKSTOP SHARES, LENDERS SHARES AND LENDERS WARRANTS AND (II) CAUSE YOUR DESIGNATED HOLDER AFFILIATE TO EXECUTE THIS CLAIM LETTER (IN ADDITION TO YOU). YOU WILL BE RESPONSIBLE FOR MAKING ALL NECESSARY OR APPROPRIATE ARRANGEMENTS AS BETWEEN YOU AND YOUR DESIGNATED HOLDER AFFILIATE TO ENSURE THAT THE LATTER CAN RECEIVE AND BENEFICIALLY OWN THE MCBS, LENDERS BACKSTOPSHARES, LENDERS SHARES AND LENDERS WARRANTS TO BE DISTRIBUTED BY THE INFORMATION AND SETTLEMENT AGENT ON BEHALF OF THE SECURITY AGENT.
